Quick Summary

A 1031 exchange allows investors selling investment property to defer capital gains tax by identifying and acquiring like-kind replacement property of equal or greater value within the required time frame.

The 1031 exchange has two strict deadlines that cannot be extended:

• 45-Day Identification Period: You must identify potential replacement properties in writing within 45 days of closing the relinquished property.

• 180-Day Exchange Period: You must close on the replacement property within 180 days of closing the relinquished property (or the due date of your tax return, whichever is earlier).

Both deadlines start from the closing date of the relinquished property. Missing either deadline disqualifies the exchange.

⚠ Note: If your 45-day or 180-day deadline falls on a weekend or federal holiday, there is no automatic extension. Plan to complete identification or closing before that date. Also, your 180-day deadline is capped at your tax return due date for the year of sale unless you file a tax return extension, in which case the full 180 days applies.
